Compensation received after accident at work fatality

The house building company Linden Ltd and a self-employed worker have been fined after three men were crushed by industrial machinery. The accident caused the death of one of the men and severely injured the other two men.

Mr Michael Whateley, 28 who was a tiler by trade was waiting in a car for a building plot to be unlocked at the time of the accident. Mr Whateley died after a telehandler toppled over and crushed the roof of the car.

The other two men in the car both sustained severe personal injuries including brain, neck and spinal injuries.

Self-employed construction plant operator Keith Payne was undertaking routine checks of the telehandler when the accident occurred.

It was found that had My Payne been following the operating instructions of the machinery the accident would have been preventable. Linden Ltd admitted liability to breaching regulation 5 of the Provision and Use of Work equipment Regulations 1998.
