Fatality caused by failure to maintain forklift truck

A plant hire firm and a mechanic who worked for the firm have been fined over the death of an employee whose forklift truck overturned whilst he was operating it. 

Mr Keith Nappin was operating the truck when the vehicle overturned and he was fatally injured.

The Health and Safety Executive prosecuted Morgans Plant Hire Ltd over the accident, finding that it failed to ensure the truck was in good working order when Mr Nappin came to use it. 

Company mechanic, Mr Matthew Edwards had also failed to ensure the health and safety of his co-worker after he had previously incorrectly modified the brakes on the vehicle.

Morgans Plant Hire was fined £50,000 as compensation after admitting breaching the Health and Safety at Work Act 1974. Mr Edwards was also found to be in breach of the same act and was fined £2,000
