Accident at work results in £75,000 in personal injury compensation
A few weeks before he was due to be made redundant Mr John Walter, 62, was lifting metal sheets in an awkward position at work when he suffered a back injury which left him unable to work. A claim was made against his employers citing that Mr Walters had been exposed to unsafe lifting practices and that mechanical aid should have been made available to assist the job.
His employers admitted liability, however did not agree as to the value of the claim. They argued that as he was being made redundant in the course of a matter of weeks and was approaching the age of 63 his realistic chances of finding work would have been limited and that his loss of earnings would have been limited.
Mr Walters argued that he enjoyed his work and was specifically entitled to compensation for loss of the congeniality of the work environment. Further evidence was also gathered which pointed to the fact that there was a thriving labour market for skilled metal workers and due to his experience Mr Walters would have quite readily secured a new position which would have seen him most likely work beyond the retirement age of 65 and up to the age of 68.
Mr Walter accepted a settlement compensation figure of £75,000
