Compensation for marine who suffered brain damage injuries in exercises
An ex-Royal Marine who suffered brain injuries after being involved in a vehicle accident during a training exercise has been awarded personal injury compensation.
Steward Daglish, 39, was a passenger in a 4x4 vehicle taking part in exercise in Scotland when the accident happened. When the driver lost control of the vehicle it overturned and crashed into a cliff. Mr Daglish suffered severe head trauma in the accident.
As a result of the accident Mr Daglish has experienced psychotic episodes and has been depressed to the point of wishing to end his life. He now requires 24 hour care.
Mr Daglish family started a personal injury claim against the Ministry of Defence (MoD) for compensation to help pay for his on going care costs. The MoD admitted liability for the crash but denied that there was a link between the crash and his subsequent condition.
The Court in 2004 found however that the injury to his brain had resulted in chronic personality disorder that involved psychotic symptoms, behavioural disturbance, impaired judgement and problem-solving difficulties.
The High Court has now approved an undisclosed lump sum in addition to annual payments to contribute to the costs of the continued care Mr Daglish will require.
