Nuisance (but not neighbour nuisance)

The Property Litigation team have considerable experience in handling nuisance-based possession proceedings where Landlords are seeking to evict tenants who are causing a nuisance. 

‘Nuisance’ not only includes noise nuisance in the most common sense, for example tenants who regularly play their music extremely loudly throughout the night, but it can also include tenants who use their properties for illegal or immoral purposes.  It is important to remember that in all cases involving nuisance a good record should be kept of all incidents of nuisance caused to other tenants, estate staff etc as these records will be required as evidence. 

Unfortunately, we do not deal with traditional ‘neighbour disputes’ where neighbours have fallen-out over several issues and are not able to resolve matters between themselves.
