Fee
The fee for the HIP you have instructed us to obtain for you is as shown on the pricing page on Osbornes Website. However, the following may be payable in addition to this fee:
- If the property is leasehold, information may need to be obtained from the landlord or managing agents and they may make a charge for this information. This additional fee will be added to the fee for the HIP and it may need to be paid in advance. The fee will vary depending on what the landlord or managing agents charge.
- If there are documents listed in the title and copies of these are required or the property is unusual and futher information is required, an additional fee may be added to the fee payable for the HIP. Again this may need to be paid in advance.
Timescale
We aim to provide the HIP within 5–10 working days and the Energy Performance Certificate within 5 working days. However, we cannot guarantee these timescales as we will be dealing with third parties, but will endeavour to produce the HIP as quickly as we can.
Payment
If you have decided to pay up front for the HIP, you agree for us to take the fee for the HIP from your credit card now.
If you have taken the deferred payment option, you agree to:
- Osbornes taking the full fee for the HIP from the sale proceeds or from your credit card provided immediately that completion takes place, if completion takes place within 6 months of the date of your instruction to us to prepare the HIP
- Osbornes immediately taking the full fee for the HIP from your credit card if completion does not take place within 6 months of you instructing to us to prepare the HIP
- Osbornes immediately taking the full fee for the HIP if you take the property off the market within 6 months from the date of your instruction to us to prepare the HIP
Interest will be charged at 4% above the base lending rate of The Royal Bank of Scotland plc applicable on the date that the payment is due for any late payments or defaults. We will charge any additional time incurred dealing with late payments or defaults at an hourly charge out rate of £100.00 plus VAT. You agree that Osbornes can take all interest payments and fees for additional time incurred from your credit card.
Authority to Estate Agents
If we are not dealing with your conveyancing you agree to ensure that your estate agent notifies us of:
- The name and address of your conveyancing solicitor
- When an offer has been accepted
- When exchange of contracts has taken place, the date of exchange and completion
- When completion has taken place
Termination
If you wish to terminate your instructions to us, you must do so in writing and the full fee for the HIP will become payable immediately.
We may stop acting for you if we have reasonable reason to do so.
Construction of the HIP
The cost of the HIP includes the provision of two paper copies, one of which we will retain and the other will be forwarded to your estate agents. If you require further copies, these can be provided at an additional cost of £15.00 (including VAT). The HIP will also be provided in electronic format and can be emailed to you and any other person or body that you request, for example your estate agent.
Archiving
In accordance with our firm’s storage policy, the HIP will be placed on your file and archived and stored in our central storage depot where it will be retained for at least 15 years. If at any time in the future you require any further assistance in this matter, we can retrieve your file, although we reserve the right to make a small charge to cover the administrative costs which this will incur.
Consumer Protection Regulations
The Consumer Protection (Distance Selling) Regulations 2000 (as amended) include a 7 working day cooling off period allowing you to cancel an order during the first 7 working days. You hereby acknowledge that we may start work on providing the HIP immediately your instruction is received and that you waive your right to the cooling off period.
